GENERAL TERMS AND CONDITIONS OF SALE
1. GENERAL
In the hereby general terms and conditions form, all « we » and « our » terms refer to ateliercuisine.ch sàrl and « you » stands for the customer.
The word « order » is used as a general term and encompasses the purchasing of gift vouchers, products as well as the booking of a date to organize classes inside our premises.
« Public classes » stands for the classes offered on our website under the tag « classes schedule ». On the contrary, « Private classes » refers to the classes offered under the tag « classes for groups ».
When making a reservation, the customer acknowledges that he/she has read, understood and unconditionally accepted the sales conditions and general liability terms. The hereby terms of use are a legal and binding contract between the ateliercuisine.ch Sàrl and the customer.
All prices shown on the website are in Swiss Francs. All prices indicated on the confirmation form are authoritative. In case a mistake is made on the price of an offer or on a offer, atelliercuisine.ch Sàrl reserves the right to change the information published on the the site at any time. We will however offer the possibility to our customer to cancel its order if he/she disagrees with the new price.
2. CONFIRMATION OF ORDER
Booking of Public classes and gift vouchers :
Once the order form has been filled and the order confirmed by clicking on the button « confirm the order », it is conclusive. When passing an order, you agree to buy the products and services previously selected. We reserve the right to refuse an order for any reason whatsoever, we may refuse any order that appears abnormal or incomplete.
Booking of private classes :
By confirming your booking, whether it is done by e-mail or by phone, you commit yourself and your firm to fully and unconditionnally respect all hereby general terms and conditions of sale.
For individuals, classes are paid cash at the end of the workshop. We do not have a credit card and postcard reader device carte EC.
For companies, classes are paid upon invoice and within 10 days.
After this period, the fees below will be charged :
First and unique reminder, CHF. 30.- for administrative fees
Followed by summons, CHF. 100.- for additional administrative fees
You also commit your company to bear all the costs related to the collection fees of our invoice.
When confirming your reservation, you testify you are 18 years old and above.
3. CANCELLATIONS
Public classes :
All cancellations, whatsoever the reasons, are to be communicated 10 working days before the cooking class date. Once this period has passed, we will not accept any refund or postponing of the class.
You are welcome to send someone in your place if you are unable to attend your class.
Private classes :
Any change in the number of participants must be communicated 10 working days before the date of the class at the latest.
Once this period has passed, all cancellations, either total or partial, whatsoever the reasons, will be charged full rate and payed by the persons attending the workshop.
In case of total cancellation, the payment of the whole invoice will be will be asked to the person who made the reservation.
In case of a cancellation for a class payed with a gift voucher, the latter will be considered as used and will therefore not be valid anymore.
All cancellations announced within the proper period of time will be integrally refunded.
4. GIFT VOUCHERS
Gift vouchers are valid 1 year from the date of purchase.
Both the validity date and the value of the gift voucher are written on the back of it.
Any gift voucher which does not have a value, a number, a validity date is not valid.
Gift vouchers are not redeemable for money. However it can be used by a third party.
If the value of the gift voucher is superior to that of the class, a new gift voucher with the difference in value will be issued. This new gift voucher will be valid for 1 year.
Valid gift vouchers may be used for private worshops as well.
5. PERSONAL INFORMATION
We commit ourselves to respect all federal laws regarding data protection. ateliercuisine.ch sàrl does not sell, rent or trade your personal information to third parties. The customer can at any time change its personal information or ask us to delete everything.
6. COPYRIGHT
All the elements used on the website (logo, trademark, descriptions, photgraphs) are the exclusive intellectual property of ateliercuisine.ch sàrl. None of the previous elements may be reproduced, either in part or in full, without prior authorization from ateliercuisine.ch sàrl. A written request has to be sent to us. We will then see how we can help you.
According to the article 231.1 in the Swiss Civil Code any element reproduced, either in part or in full, from our website will lead to the copyright payment. The payment of copyright fees is also mandatory when some or all the elements on the website are reproduced to create a new entity.
In case of full or partial reproduction of our website without our prior written authorization you agree to pay CHF. 500.- per photograph and to never use them again.
All trademarks listed on our website have been authorized by their respective owners and are there only for guidance.
7. LITIGATIONS
The contract hereby is governed by Swiss law. In case of a litigation, ateliercuisine.ch sàrl reserves the right to chose the court to submit the litigation to.
8. OTHER CASES
For all other cases not governed by this general terms and condition of sale, the Swiss obligation code will apply.
9. RESPONSABILITY
We do not guarantee that www.ateliercuisine.ch is free from errors or faults. We will however make our best efforts that information on the website is accurate.
Pictures on the website as well as products are only shown in an informative way and are not binded to the contract.
Atelier cuisine Sàrl reserves the right to cancel a scheduled class or a private workshop in case of unforeseen exceptional circumstances. Menus are also subject to change without prior notice..
